1. Description of Promotion

Welcome to the BetIt GetIt Promotion (the “Promotion”), where eligible participants who complete the Wager Method of Entry (as defined below) or the Alternate Method of Entry (as defined below) will receive an Entry (as defined below) into the Promotion, and winners of the Promotion will receive a Suggested Bet Feature (as defined below) and one hundred dollars ($100) in Bonus Bets for use only in the FanDuel Sportsbook app (“Sportsbook Bonus Bets”).

The Promotion is sponsored by Betfair Interactive US LLC (“FanDuel” or “Sponsor”), located at 6701 Center Drive West, Suite 1000, Los Angeles, CA 90045. The terms “you” or “your” mean the person who participates in this Promotion. Participation in the Promotion is expressly conditioned upon acceptance of and compliance with all of these Promotion “Terms and Conditions.” Promotion participants may be required to sign paperwork issued by Sponsor.

2. Promotion Period

The Promotion will begin on or around 8:00 p.m. Eastern Time (“ET”) on June 11, 2024 and all entries must be received by 2:59 p.m. ET on June 12, 2024 (“Promotion Period”); provided that entrants may only enter the Promotion within certain time periods during the Promotion Period, as indicated below:

(Each such time period, a “Promotion Day,” and each such eligible game, an “Eligible Game”).

3. Eligibility

The Promotion is only open to individuals who, at the time of entry, are at least eighteen (18) years of age and physically present in the District of Columbia or are at least twenty one (21) years of age and are physically present in the States of Arizona, Colorado, Connecticut, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana (excluding the following parishes: Caldwell, Catahoula, Franklin, Jackson, LaSalle, Sabine, Union, West Carroll and Winn), Maryland, Massachusetts, Michigan, New Jersey, New York, North Carolina, Ohio, Pennsylvania, Tennessee, Vermont, Virginia, West Virginia or Wyoming. If your Social Security number is associated with another FanDuel Account (as defined below) in Sponsor's database, you may only earn one (1) Promotion Bonus (as defined below) per Promotion Day with respect to all such FanDuel Accounts participating in this Promotion. Employees, officers and directors of Sponsor, Olivia Moody (“Liv Moods”) and each of their respective parent companies, affiliates, cable/satellite affiliates, advertising and promotion agencies, prize providers, retailers, distributors (collectively, the “Promotion Entities”), and each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to participate in the Promotion or receive a Promotion Bonus. For purposes of this Promotion, “immediate family members” are defined as spouse, partner, parents, legal guardians, in-laws, grandparents, siblings, children and grandchildren and “those living in the same household” shall mean people who share the same residence at least three (3) months a year, whether legally related or not. A person cannot be an eligible participant or winner if such person is a person: (a) with whom U.S. persons or entities are restricted from doing business under regulations of the Office of Foreign Asset Control (“OFAC”) of the Department of the Treasury (including those named on OFAC’s Specially Designated and Blocked Persons List) or under any statute or executive order; or (b) who is acting, directly or indirectly, for or on behalf of any such person. Void where prohibited by law. Individuals who have entered any self- limited or government agency self-exclusion program or have been otherwise excluded from casinos by a government agency, Sponsor or one of its affiliates or gaming license partners and persons on a Disassociated Patrons, Self-Limit, Involuntary Exclusion, Voluntary Exclusion or Self Exclusion List in jurisdictions which Sponsor or its affiliates or gaming license partners operate are not eligible to participate in the Promotion or receive a Promotion Bonus.

4. Action Required

Eligible individuals must have an X account (“X Account”), to participate in this Promotion. If you don’t already have an X Account, visit www.twitter.com to create a X Account; creating an X Account is free. By submitting your information and creating an X Account, you will be required to agree to the X terms of service and privacy notice. If you do not agree to X’s terms of service and privacy notice, you cannot create an X Account or participate in this Promotion. Participants must have their X Account set to public as Sponsor may not receive Entries (defined below) from X users with private accounts. Then, you may enter the Promotion via one (1) of two (2) methods of entry:

• Wager Method of Entry: To enter this Promotion by placing a wager, eligible individuals must have an active FanDuel Account. Then, on a given Promotion Day, use your FanDuel Account to place a four (4) leg or more Same Game Parlay wager of at least one dollar ($1) (in real money) on any Eligible Game in accordance with Section 2 above, provided that the final price of your Same Game Parlay wager must be +400 or longer. Your wager cannot be more than six (6) legs and/or longer than +5000 odds. Then, using your X Account, you must reply in the thread to the call to action posted by the official FanDuel Sportsbook X account @FDSportsbook with a screenshot of your submitted FanDuel bet slip (in the FanDuel Sportsbook app) of your wager. The foregoing method of entry is defined as the “Wager Method of Entry.”
• Alternate Method of Entry: To enter this Promotion without placing a wager, eligible individuals must have an active FanDuel Account. Then, on a given Promotion Day, use your FanDuel Account to create a four (4) leg or more Same Game Parlay wager of at least one dollar ($1) on any Eligible Game in accordance with Section 2 above, provided that the final price of your Same Game Parlay wager must be +400 or longer. Your unsubmitted wager cannot be more than six (6) legs and/or longer than +5000 odds. Then, using your X Account, you must reply in the thread to the call to action posted by the official FanDuel Sportsbook X account @FDSportsbook with a screenshot of your unsubmitted FanDuel bet slip (in the FanDuel Sportsbook app) of your wager. The foregoing method of entry is defined as the “Alternate Method of Entry.” For clarity, the Alternate Method of Entry is free and does not require you to submit the bet slip of your wager.

Participants who satisfy the Wager Method of Entry or the Alternate Method of Entry will receive one (1) entry into this Promotion (an “Entry”). Participants may submit a limit of five (5) Entries per person per Promotion Day (regardless of method), however each Entry must be unique (i.e., different than the other Entries you submit).

• Entries that do not meet the following “Content Guidelines” are subject to disqualification and/or removal from the Promotion, each at Sponsor’s sole and absolute discretion, so read and follow these Content Guidelines:
• Entries must comply with these Terms and Conditions and any terms of use posted on X, and meet all specifications or requirements called for in any other advertising for the Promotion.
  
• During the Entry Period, Entries cannot be displayed or distributed except by us and you must maintain all rights, without third party obligations, to transfer your Entry to us if you are selected as a winner.
• Except for materials that are in the public domain, each Entry, in its entirety, must be a single work of original material created by the entrant, or for which entrant has all rights required to comply with these Terms and Conditions, and suitable for presentation in a public forum.
• Entries must not have been submitted previously in any contest of any kind or exhibited or displayed publicly (i.e., disclosed beyond your immediate circle of friends and family) through any means previously.
• Except for materials in the public domain, Entries must include only materials created by the entrant, or for which entrant has all rights required to comply with these Terms and Conditions, and must not infringe on the intellectual property rights of any other person or entity. Sponsor does not permit the infringement of others’ rights and any use of materials that infringe third party rights is grounds for disqualification from the Promotion and may subject you to liability. Do not copy your favorite movie, book or photo or include materials, images, graphics, music or trademarks belonging to any third parties or incorporate the names, voices, likeness or personas of any party other than yourself. Entries that contain brand names, trademarks or company logos are subject to disqualification.
  
• Entries must not include material that: (a) is sexually explicit, indecent, obscene, violent, hateful, tortuous, defamatory, slanderous or libelous, (b) is derogatory or promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, (c) invades the privacy or publicity rights of any person, living or deceased, (d) is unlawful (e) is harmful to other users of any websites, such as viruses, Trojan horses or other technologies that could adversely impact the Promotion, and/or (f) is disparaging to Sponsor or is inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate (at Sponsor’s sole and absolute discretion).

• Entries should not reveal any personal information about another individual, including another person’s address, phone number, email address, credit card number or any information that may be used to track, contact or impersonate that individual.
• Entrants must not submit an Entry that if selected cannot be assigned to Sponsor as contemplated below.

Sponsor’s database clock will be the official timekeeper for the Promotion. Those who do not follow all of the instructions, provide the required information in their registration form or abide by these Terms and Conditions or other instructions of Sponsor may be disqualified at Sponsor’s sole and absolute discretion. In the event a participant engages in behavior that (as determined by Sponsor in its sole and absolute discretion) is obnoxious, inappropriate, threatening or illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the individual’s participation in the Promotion early and remove them from the Promotion.

Subsequent attempts made by the same individual to submit multiple Entries by using multiple or false contact information, accounts or otherwise may result in the entrant being disqualified. Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified. No mechanically reproduced Entries or illegible, incomplete, forged or altered Entries will be accepted. Sponsor is not responsible for late, lost, stolen, misdirected, misplaced, stolen, tampered with, deleted, invalid, damaged or garbled Entries. All Entries become the exclusive property of Sponsor and will not be returned. All Entries become the physical property of Sponsor and will not be acknowledged or returned. Assurance of delivery of Entries is the sole responsibility of the participant.

In the event of a dispute as to the identity of any participant who submits an Entry, the Entry will be deemed submitted by the registered account holder of the email or other account from which it was sent but only if such person is otherwise eligible. The “registered account holder” is the person assigned an email address or username by the entity responsible for assigning it (e.g., X or FanDuel). Winners may be required to show proof of being the registered account holder. If a dispute cannot be resolved to Sponsor’s satisfaction, the Entry will be deemed ineligible.

5. Intellectual Property.

Each entrant, upon submission of their Entry, irrevocably grants to Sponsor, and each of its licensees, successors and assigns, the non-exclusive, perpetual, royalty-free, no-cost license and right to use and otherwise exploit the Entries, and all images, text and materials included or depicted therein, in whole or in part, in any manner or medium now or hereafter known or devised (including, without limitation, CDs, streaming media, film, television, videocassettes, print, interactive devices, mobile media, Internet and online systems), throughout the universe and in any and all languages, including, without limitation, the right to display, reproduce, recreate, record, perform, exhibit, distribute, copy, edit, change, modify, add to, subtract from, re-title and adapt the same, to combine it with other material and otherwise use and exploit it without having to give any compensation or attribution to entrants or any third party, except for the awarding of the prizes to the winners in this Promotion. Entrants agree that during the Promotion Period, they shall not make, and shall not permit, any other public use, display or distribution of the Entries, and they shall maintain all rights without encumbrances so that, if Sponsor desires, entrants can assign all rights in and to Entries if selected as a winner. Sponsor, and each of its successors, assigns and licensees, will have the right to make unlimited derivative works of Entries, to assign or transfer any or all of Sponsor’s granted rights and to grant unlimited, multiple-level sublicenses. Without limiting the forgoing, Sponsor will have the right to use the Entries submitted as part of the Promotion, and all images, text and materials included or depicted therein (if any), in any merchandising, advertising, marketing, promotion or for any other commercial or non-commercial purpose. Entrants hereby forever waive and relinquish all “moral rights (droit moral)” now or hereafter recognized in connection with Entries submitted as part of the Promotion. Entrants acknowledge that as a condition of participating in the Promotion and/or being selected as a winner, Sponsor may request that the entrant’s Entry, and any rights therein, be assigned to Sponsor and entrants may be required to confirm such assignment by completing and submitting the Affidavit (defined below) (and any other documents reasonably required by Sponsor) or such entrant will otherwise be disqualified from receiving their prize. Entrants must maintain the ability to assign all such rights to Sponsor free of any limitations, restrictions or third party obligations. Entrants agree that Sponsor shall have the sole discretion in determining the extent and manner of use of Entries and are not obligated to use any Entry. Entrants agree that Sponsor, nor its agents, shall be responsible for return or preservation of the Entries submitted. All Entries that are posted in accordance with these Terms and Conditions or elsewhere are available to be viewed by anyone with access to the internet.

Each entrant acknowledges that Entries are not being submitted in confidence or in trust to Sponsor and that no confidential or fiduciary relationship is intended or created. Each entrant acknowledges that Sponsor and other entrants may have created ideas and concepts contained in their Entries that may have familiarities or similarities to their own Entry, and that they will not be entitled to any compensation or right to negotiate with the Promotion Entities because of these familiarities or similarities. Notwithstanding any custom and practice in the industry to pay an individual for an idea (if any), nothing herein shall create an implied or express contract to compensate entrants for their Entries and there is no obligation for any Promotion Entity to pay or otherwise compensate entrants for any of their ideas or materials in any communications with Sponsor, whatsoever. Entries are not confidential and the Promotion Entities’ only obligations to entrants regarding Entries are as specifically set forth in these Terms and Conditions. Entrant, by participating in the Promotion, except where legally prohibited, grants permission for Sponsor and its designees to use their name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. Sponsor reserves the right to request from entrant at any time proof that entrant maintains all necessary rights in their Entry in order to grant Sponsor the rights required herein in a form acceptable to Sponsor. Failure to provide such proof may lead to, among other things, the entrant being disqualified from the Promotion.

6. Determining the Winners

After the conclusion of a Promotion Day, each Entry will be reviewed by Liv Moods, who will review and judge all eligible Entries received during that Promotion Day based on the following judging criteria (collectively, the “Judging Criteria”):

• 33.33%: Creativity of the Same Game Parlay

• 33.33%: Variety of markets (e.g., straight markets, player prop markets, etc.) in the Same Game Parlay

• 33.33%: Variety of players in the Same Game Parlay

Based on the total score Liv Moods assigns to each Entry using the Judging Criteria, one (1) winning Entry per Promotion Day will be ultimately selected by Liv Moods and each individual who submitted a selected Entry will be potential “Winners,” subject to confirmation that the potential Winners have met the eligibility requirements and complied with these Terms and Conditions. If there is a tie after Liv Moods applies the Judging Criteria, Sponsor will bring in a tie breaking judge to apply the same Judging Criteria to break the tie and determine the Winner.

7. Claiming Promotion Prizes

Each winner will receive the wager they screenshotted in their Entry featured as a suggested bet on FanDuel’s Sportsbook app and/or website homepage (the “Suggested Bet Feature”). In addition to the Suggested Bet Feature, each winner will receive Sportsbook Bonus Bets equal to one hundred dollars ($100) (collectively with the Suggested Bet Feature, the “Promotion Bonus”). A Winner’s Suggested Bet Feature will be displayed on FanDuel’s Sportsbook app and/or website homepage during a time period determined by Sponsor in its sole and absolute discretion. The purchase of any goods or services will not increase any participant’s chances of winning.

Winners will be notified via direct message to their X Account used to submit their Entry in a commercially reasonably time after the drawing for that Promotion Day, and Winners will be required to provide Sponsor with their active FanDuel Account usernames to confirm compliance with these Terms and Conditions and receive their Promotion Bonus. Notification is deemed to have occurred immediately upon the sending of a direct message to your X Account that you are a potential Winner. Winners must communicate to Sponsor their FanDuel Account username within the timeframe specified by Sponsor otherwise the Promotion Bonus may be forfeited. The Promotion Entities are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s X Account to receive direct messages.

Sportsbook Bonus Bets may be used to wager on any market available in the FanDuel Sportsbook app except for Round Robin wagers. If a wager placed using a Sportsbook Bonus Bet wins, you will receive as withdrawable cash the winnings portion of such wager and will not receive the stake portion (in cash or site credit) from such wager. Sportsbook Bonus Bets can be found in the bet slip window of your FanDuel Account. Any Sportsbook Bonus Bets earned will be credited to your FanDuel Account within seventy-two (72) hours of your selection as a Winner.

The Promotion Entities are not responsible for false, incorrect, changed, incomplete or illegible contact information. Each potential Winner may be required to submit an affidavit of eligibility / release of liability / prize acceptance agreement (collectively, the “Affidavit”) and return the Affidavit within the time period specified at notification before being eligible to receive their Promotion Bonus. If a potential Winner fails or refuses to sign and return such Affidavit within the time period required by Sponsor or if a Promotion Bonus or Promotion Bonus notification is returned as rejected, faulty, unclaimed or returned as undeliverable to such potential Winner, such potential Winner may be disqualified and an alternate may be selected. Non-compliance shall result in disqualification and the Promotion Bonus will be awarded to an alternate Winner. The Promotion Entities are not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected or unsuccessful efforts to notify a potential Winner. If a potential Winner fails to respond and/or collect their Promotion Bonus within the time period specified by Sponsor, Sponsor reserves the right, in its sole and absolute discretion, to disqualify such potential Winner and to select an alternate potential Winner from the remaining qualifying participants. If any potential Winner is found to be ineligible, or if they have not complied with these Terms and Conditions, or if a potential Winner cannot redeem any portion of the Promotion Bonus, or declines a Promotion Bonus for any reason prior to award, such potential Winner may be disqualified and an alternate potential Winner may be selected. Sponsor will have complete discretion over interpretation of the Terms and Conditions, of administration of the Promotion and of selection of the Winners. Decisions of Sponsor as to the selection of the Winners will be final.

Promotion Bonus recipients will be solely responsible for all federal, state and local taxes, and for any other fees or costs associated with the Promotion Bonuses received, regardless of whether the Promotion Bonuses, in whole or in part, are used. Promotion Bonuses are non-transferable, with no equivalents or substitutions except at Sponsor’s sole and absolute discretion. All Promotion Bonus details not specified in these Terms and Conditions will be determined in Sponsor’s sole and absolute discretion. Promotion Bonus details and availability are subject to change and prize provider’s rules and restrictions, and in the event that Sponsor is unable to provide the Winners with their Promotion Bonuses, Sponsor may elect to provide Winners with the approximate value of such item in cash or award an alternate prize of comparable or greater value. The Promotion Bonuses are awarded “AS IS” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). The ARV of the Promotion Bonuses is based on available information provided to Sponsor and the value of any Promotion Bonus awarded to a Winner may be reported for tax purposes as required by law. The Winners may be required to provide Sponsor with a valid Social Security number before the Promotion Bonuses will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of a Winner. Unclaimed Promotion Bonuses will be forfeited. Promotion Bonuses, if legitimately claimed, will be awarded. The Promotion Entities are not responsible for and will not replace any lost, mutilated or stolen Promotion Bonus or any Promotion Bonus that is undeliverable or does not reach a Winner because of an incorrect or changed address, account name, etc. If a Winner does not accept or use the entire Promotion Bonus, the unaccepted or unused part of the Promotion Bonus will be forfeited, and the Promotion Entities will have no further obligation with respect to that Promotion Bonus or portion of the Promotion Bonus. The total ARV of all prizes awarded in this Promotion is two hundred dollars ($200). The Promotion Entities are not responsible for, and Winners will not receive the difference, in any, between the actual value of a Promotion Bonus at the time of award and the stated ARV in these Terms and Conditions or in any Promotion-related correspondence or material. Limit of one (1) Promotion Bonus per person per Promotion Day in connection with this Promotion.

8. Registration Procedures

To qualify for the Promotion, eligible individuals must register for an active FanDuel member account and verify your identity in order to play in the FanDuel Sportsbook app (“FanDuel Account”). Creating a FanDuel Account at www.fanduel.com or https://sportsbook.fanduel.com is free. By submitting your information and creating a FanDuel Account, however, participants will be required to agree to the FanDuel Terms of Use (https://www.fanduel.com/terms) and consent to the FanDuel Privacy Policy (https://www.fanduel.com/privacy). If you do not agree to FanDuel’s Terms of Use and consent to FanDuel’s Privacy Policy, you cannot create a FanDuel Account or participate in this Promotion.

9. Limitations on Participation

In addition to the eligibility requirements in Section 3 above, FanDuel reserves the right to refuse or otherwise restrict your eligibility to participate in this Promotion for any reason, in its sole discretion, including based on your wagering patterns or wagering history or if you failed to take advantage of any previous promotion in good faith. Wagers placed to enter into this Promotion will not satisfy any wager or other promotion requirements for a separate Sponsor promotion. If you are opted into two (2) or more promotions with wagering requirements, your wagers will count towards the first opted-in promotion. This Promotion is void where prohibited by law. Limit of five (5) Entries per person per Promotion Day. Limit of one (1) Promotion Bonus per person per Promotion Day.

Participants entering the Promotion concurrently with wording, depiction, or images that FanDuel considers, in its sole discretion, to be vulgar, profane, offensive or otherwise inappropriate shall not be eligible for the Promotion.

Proof of liking and/or commenting on any Promotion social media post does not constitute proof of receipt or entry into the Promotion.

10. Wagering Requirements/Exclusions

See Section 4 above.

11. Order of Funds Used for Wagering

Sportsbook Bonus Bets must be manually selected in the bet slip window of your FanDuel Account in order to be used before deposited funds when wagering.

12. Eligible Games

Any NBA game taking place between 7:00 p.m. and 10:30 p.m. ET on June 12, 2024 in accordance with Section 2 above is eligible for the Wager Method of Entry or Alternate Method of Entry to enter into this Promotion.

Sportsbook Bonus Bets may be used to wager on any market available in the FanDuel Sportsbook app except for Round Robin wagers.

13. Restrictions on Withdrawal

Promotion Bonuses are not transferable and cannot be substituted except in the Sponsor’s sole discretion. Sportsbook Bonus Bets are non-withdrawable, but any winnings therefrom are immediately withdrawable. Any unused portion of the Sportsbook Bonus Bets will be automatically withdrawn from your FanDuel Account seven (7) days after being credited to your FanDuel Account. Deposited funds that have not been played may be refunded at any time.

14. Complaints & Cancellation

Should you wish to cancel your participation in this Promotion at any time, please contact customer support at https://support.fanduel.com/s/. Upon cancellation, you may withdraw any funds you have deposited into your FanDuel Account without restriction. However, any Sportsbook Bonus Bet amount in your FanDuel Account may not be withdrawn. For customers located in New York, complaints may be filed with the New York State Gaming Commission.

16. Additional Terms

Administration: Sponsor expressly reserves the right to amend, suspend or terminate this Promotion at any time without prior notice or consent. Administration of this Promotion is at the sole discretion of Sponsor. Sponsor reserves the right to restrict at any time any person from participating in this Promotion for any reason. In the event Sponsor is prevented from continuing with the Promotion by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Promotion by any party, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each, a “Force Majeure” event or occurrence), Sponsor shall have the right to modify, suspend or terminate the Promotion or Promotion Bonuses. Sponsor additionally reserves the right, in its sole and absolute discretion: (i) to modify, suspend or terminate the Promotion should a Force Majeure event or occurrence corrupt or interfere with the administration, integrity, operation, security or proper play of the Promotion; or (ii) to disqualify any entrant found to be, or suspected of: (a) tampering with the entry process or the operation of the Promotion; (b) acting in violation of these Terms and Conditions; or (c) acting in an unsportsmanlike manner.

Any questions relating to eligibility, these Terms and Conditions or any other questions concerning this Promotion will be resolved at the sole discretion of Sponsor and its decisions will be final and binding with respect thereto. No groups, clubs, corporations, companies, partnerships or organizations may reproduce or distribute any portion of these Terms and Conditions to their members.

Release and Waiver of Liability: By participating in this Promotion, participants agree to release, defend, indemnify and hold harmless the Promotion Entities, X and each of their directors, officers, employees, representatives and agents (collectively, the “Released Parties”) from and against any and all liability claims, actions, costs (including attorneys’ fees) of any kind whatsoever (however named or described) for injuries, death, damages or losses in connection with:

(i) your participation in the Promotion; (ii) the receipt, use or misuse of the Promotion Bonus, or while preparing for, participating in, and/or traveling to any Promotion-related activity, including those damages caused by Sponsor’s own negligence; (iii) compliance with any terms of service, code of conduct or similar terms and conditions; (iv) the Released Parties’ actual or alleged violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or claims of infringement of intellectual property or other rights; and (v) any typographical, human or other error in the printing, offering, selection, operation or announcement of any Promotion activity or Promotion Bonus. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of a Promotion Bonus.

Publicity: Subject to applicable law, Winners irrevocably grant the Promotion Parties and each of their licensees, and its and their successors, assigns and sub-licensees the right and permission to use their name, voice, likeness and/or biographical material, location, social media posts and/or photos and videos tagged in response to Promotion posts for advertising, promotional and/or publicity purposes in connection with the Promotion, in all forms of media and by any and all means and media (now and hereafter known), and on and in connection with related products, services, advertising and promotional materials (now known or hereafter developed), worldwide, in perpetuity, without any obligation, notice or consideration, except for the awarding of the Promotion Bonuses to the Winners. No Third-Party Sponsor: This Promotion is in no way sponsored, endorsed, or administered by, or in association with any person or other entity, including any third party, other than FanDuel. X, Facebook and Instagram collectively “Social Media Sites” are not sponsors, endorsers, or affiliated in any way with the Promotion. All questions regarding the Promotion must be directed to Sponsor, not any Social Media Site. You agree as a condition of participating in the Promotion that you shall release Social Media Sites from any and all liability arising out of or relating to your Entry, creation of an Entry, submission of an Entry, participation in the Promotion, acceptance, use or misuse of any Promotion Bonus, or the broadcast, exploitation or use of an Entry.

Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions or the rights and obligations of participants and Sponsor in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

Dispute Resolution: You agree that any claim or dispute that has arisen or may arise relating in any way to or arising out of the Promotion or these Terms and Conditions will be resolved in accordance with the dispute resolution provisions set forth in the “Binding arbitration and class action waiver” Section of the FanDuel Terms of Use (https://www.fanduel.com/terms). This Section of the FanDuel Terms of Use requires you to resolve disputes by binding arbitration and you agree to waive the ability to bring claims in a class action format.

LIMITATION OF LIABILITY: BY ENTERING THIS PROMOTION, ENTRANTS AGREE THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (I) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION OR PROMOTION BONUSES AWARDED WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (II) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (III) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (IV) ENTRANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

Miscellaneous: No waiver of any of the provisions of these Terms and Conditions shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect. Entrants agree to waive any rights to claim ambiguity of these Terms and Conditions. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion-related materials, privacy policy or terms of use on any website, social media platform or application and/or the terms and conditions of these Terms and Conditions, these Terms and Conditions shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.

Entry Information and Promotion Communications: As a condition of entering the Promotion, each entrant gives consent for Sponsor to obtain and deliver their name, address and other information to third parties for the purpose of administering this Promotion and to comply with applicable laws, regulations and rules. Any information entrant provides to Sponsor may be used to communicate with entrant in relation to this Promotion or on a Promotion Winners list.
